Family tried to get Jackson to stop taking drugs, detective says

Michael Jackson’s family tried over and over to talk with the pop singer about his drug abuse and attempted one intervention at his Neverland retreat, a Los Angeles police detective who interviewed Michael Jackson’s mother testified Thursday.

Det. Orlando Martinez said that when he interviewed Katherine Jackson on Dec. 9, 2009 — months after Jackson’s death — she told him she had never met nor known about Dr. Conrad Murray until her son died. Murray, who gave the singer a lethal dose of propofol, is now serving a jail sentence for involuntary manslaughter.

The detective, under questioning from the attorney representing the Jackson family in a wrongful death case against concert promoter AEG, also verified that he wrote the following summary about that discussion:

“Mrs. Jackson stated that she last spoke with Michael at his residence on Carolwood approximately one and a half weeks prior to his death. When asked if Mrs. Jackson had ever met Dr. Murray she stated that she had not and didn’t even know who he was until after Michael’s death.

“Mrs. Jackson was asked if she or any other family members ever attempted to do an intervention with Michael as it relates to painkillers or any other drugs. She stated that there had been one attempted intervention at Neverland on behalf of Janet, however Michael didn’t want to participate.

“Mrs. Jackson stated that she had been informed Michael had been taking drugs, however she had no idea which drugs, and she had never seen Michael take any drugs. Mrs. Jackson stated that the family attempted several times to help Michael however he would have nothing to do with it. She further stated that she had asked Michael if he was taking any drugs and Michael denied it.

“When asked if Michael had any chronic medical conditions that she was aware of, Mrs. Jackson stated that he had problems sleeping and that his back frequently bothered him. She stated she thought the back pain was a result of falling off of a stage during a performance.”

Katherine Jackson has been present at the trial since it began Monday, stepping out of the courtroom only when a paramedic described finding the singer on his bed.

Jackson’s mother and the singer's three children are accusing the entertainment company of pushing the singer beyond his physical abilities and of negligently hiring and controlling Murray, who gave Jackson a fatal dose of propofol.

On Thursday, defense attorneys objected to Katherine Jackson being accompanied by her daughter Rebbie, who, like many of her siblings, is on the witness list.

Judge Yvette Palazuelos overruled the objection. “I think Mrs. Jackson should have at least one support person in the courtroom,” the judge said.

Michael Jackson had a long list of prescription drugs in his system when he died in the days before his anticipated comeback tour, a toxicologist with the Los Angeles County coroner's office testified Monday.

Dan Anderson, the first witness called in the second week of the lawsuit that Michael Jackson's mother and three children filed against entertainment giant AEG, continued what has been an unvarnished look into the entertainer’s final days.

A Los Angeles Police Department detective already testified that when he saw Jackson spread on a bed in his rented Holmby Hills mansion, the pop singer resembled an end stage cancer patient who’d come home to die. Testimony also recounted how Jackson’s family had tried to get him to quit drugs, including a failed intervention effort at this Neverland ranch.

On Monday, Anderson testified that tests of Jackson's blood, urine and internal organs showed traces of the anesthetic propofol, the anti-anxiety drugs Valium and lorazepam, the short-term anesthetic midazolam and lidocaine, a numbing cream that paramedics sometimes use in resuscitation efforts.

Anderson said that the amount of propofol found in Jackson’s system was what you'd expect in a patient who had just undergone major surgery.

The toxicologist also testified that investigators found other drugs at Jackson's home, including the antidepressant trazodone and the prostate drug Flomax.

Anderson said investigators found injectable lorazepam at Jackson's home as well, a form of the drug "typically found in a hospital setting."

The discovery of the propofol bottles outside a medical setting also was “highly unusual" and "kind of raises a red flag,” Anderson said.

Most of the drugs, he testified, were prescribed by Dr. Conrad Murray, the physician who was convicted of involuntary manslaughter for giving the singer the lethal dose of propofol that killed entertainer.

The Jackson family claims that AEG negligently hired and supervised Murray, while AEG says the doctor worked for Jackson. AEG, a major player in downtown L.A. with the Staples Center and L.A. Live, was promoting Jackson’s “This Is It” comeback tour.

Personal details about Michael Jackson were revealed Monday during his family's lawsuit against entertainment giant AEG.

Christopher Rogers, the Los Angeles County deputy medical examiner, testified Monday that the 5-foot-9 Jackson weighed only 136 pounds at the time of his death and that X-rays showed he suffered from arthritis in his lower spine and fingers.

In addition, he had a pink tattoo on his lips and dark tattoos on his eyebrows and on the top front of his head.

He also testified that Jackson suffered from a disease, more common in African Americans, in which some areas of the skin are light and others are dark.

"It can be very disfiguring," Rogers said.

A toxicologist testified Monday that Michael Jackson is the only person in Los Angeles County not in the medical field to die of propofol intoxication in their home in the last 14 years.

The comments from Dan Anderson, with the county coroner's office, appeared directed at showing that propofol is only used in medical settings and is not available from a pharmacy. The other six people who died at their homes were doctors or nurses who had access to the tightly controlled anesthetic.

Jackson died at his Holmby Hills mansion in 2009 after Dr. Conrad Murray gave him propofol to help him sleep. Jackson had been preparing for a series of comeback concerts in London.

The testimony comes in the second week of a wrongful death suit that Jackson’s mother and his children filed against AEG, the promoter that was staging Jackson’s anticipated “This Is It” concerts.

Cardiologist says Michael Jackson's doctor was unfit to save him

A cardiologist testified Tuesday that Michael Jackson's doctor gave his famous patient incorrect treatment when he noticed the singer had stopped breathing as a result of a powerful anesthetic the physician had administered.

Dr. Daniel Wohlgelernter, who has taught at Yale and UCLA and practices in Santa Monica, said that Dr. Conrad Murray used chest compressions when he saw that Jackson was in distress, rather than focusing on getting his breathing restarted.

Jackson died after Murray administered a fatal dose of propofol, a drug usually used in medical settings and most often administered to patients undergoing surgery.

The testimony comes in the second week of a wrongful death trial in which Jackson’s mother and his three children are suing concert promoter AEG. The family contends AEG hired and supervised Murray.

Wohlgelernter said Murray did not have the appropriate training to serve as Jackson's physician for the "This Is It" tour, which was expected to relaunch the pop star’s career.

Instead of a cardiologist like Murray, the expert witness said that Jackson needed a doctor who was trained in addiction medicine, substance abuse and sleep disorders.

Since Jackson had no evidence of heart disease, Murray was not an appropriate choice to treat him, the witness said.

Wohlgelernter called Murray's treating of Jackson “a mismatch. It’s not what he needs.”

Wohlgelernter said Jackson "was not fit and competent in so far as he administered medications he was not trained and credentialed to administer and administered them in a whole unsatisfactory environment."

Murray was convicted of involuntary manslaughter for giving Jackson the anesthetic propofol at the singer's Holmby Hills mansion to treat the singer's insomnia. He’s now serving a jail sentence.

Wohlgelernter testified that propofol should be given only in a hospital setting and administered by an anesthesiologist because there is a risk the patient can stop breathing.

Cardiologists, like Murray, “are not competent to administer propofol,” he said.

Jackson's family contends Murray was in a deep financial hole and would do nearly anything to ensure he would receive his $150,000 a month salary for treating Jackson.

AEG says that Jackson chose Murray as his doctor and payments the company was supposed to make to him were an advance to the singer.

Michael Jackson’s doctor showed warning signs that should have led concert promoter AEG to raise serious questions before letting him sign on as the singer’s physician for an anticipated comeback tour, a cardiologist testified Tuesday.

Dr. Daniel Wohlgelernter, who practices in Santa Monica and who has taught at Yale and UCLA medical schools, spent Tuesday as an expert witness testifying on behalf of Jackson’s mother and three children, who have filed a wrongful death suit against AEG, the entertainment company that promoted Jackson’s 50 London concerts.

Wohlgelernter said the fact that Dr. Conrad Murray, a cardiologist, shut his practice to care only for Jackson, who had no history of heart problems, “that to me is a red flag,” Wohlgelernter said. He asked why Murray would “leave what he was doing for a patient who doesn’t need his services?”

The witness also said that Murray’s request for a CPR machine, written into his contract, a device used when patients undergo heart surgery, should have raised questions.

“What is this doctor planning to do?” Wohlgelernter asked. “What are his treatment plans in taking care of Michael Jackson?”

Another warning, he said, was Jackson’s request for Murray, considering the singer’s background with drug use.

“It’s a red flag to the extent that Michael Jackson has a history of substance abuse and addiction that he specifically is requesting a given doctor who has no training in any of those areas.… What is the nature of this relationship? Why do these two want each other?”

The Jackson’s legal team called Wohlgelernter to the stand to show that not only was Murray unfit to serve as the singer’s doctor, but that AEG executives should have picked up on the danger signs.

The Jacksons claim that AEG negligently hired and supervised Murray, who gave Jackson a fatal dose of the anesthetic propofol at the singer’s rented Holmby Hills home. The Jacksons say that Murray, who was deeply in debt, would do almost anything to keep the job that was supposed to pay him $150,000 a month.

AEG maintains that Murray worked for Jackson and had treated him since 2006, and that company payments to the doctor were actually part of an advance that Jackson would have to repay.

Wohlgelernter also said he was troubled by a section of Murray’s contract that said the doctor was to “Perform the Services reasonably requested by the Producer,” which was AEG.

That meant Murray was “responsible and accountable to a third party, namely AEG Live,” Wohlgelernter said, not his patient, leading to a conflict of interest.

The expert witness said only anesthesiologists administer propofol because the patient can stop breathing. He said he had never heard of the anesthetic being used at home or to treat insomnia, as Murray had.

Asked if he had ever administered propfol, Wohlgelernter replied, “Not nowhere, not nohow.

The cardiologist said he is paid $4,250 for half a day of expert testimony and $450 an hour to prepare for testifying.

How can anyone with an IQ over 15 not see that Murray was a disastrous "doctor" and AEG did NOT do their due diligence. No wonder AEG is spreading sewage all over the media. Only the cowardly and the guilty behave this way. The innocent and the strong do not need to resort to this kind of slimy behavior.

Michael Jackson’s behavior and gaunt figure were so troublesome to a producer that she told the director of the “This Is It” concert series that she believed the singer was dying and should be immediately taken to a hospital.

Alif Sankey also testified Wednesday that the director for the concerts told her Jackson believed God was talking with him.

Sankey recalled that on her way home from rehearsal one night, she pulled her car over and called Kenny Ortega, who was directing what was to be Jackson’s comeback tour. It was only days before Jackson's first concert was to take place.

“I said, 'He needs to be put in the hospital now,' ” Sankey said. “He kept listening to me because I kept going. I kept saying, ‘Michael’s dying, he’s dying.’”

Sankey, who was emotional and paused during her testimony, said she begged Ortega to do something.

“Please, please. I kept saying that. I asked him, ‘Why is no one seeing what I’m seeing?’ ”

Sankey testified that the previous night, Jackson had been at rehearsal for a costume fitting but was sent home because he “was not looking good or feeling good.”

Afterward, Sankey said that Ortega was worried about Jackson, who mentioned God was speaking to him. Both became emotional after discussing their concern for Jackson.

“[Michael] didn’t understand why God was speaking to him. We were both crying. We were crying because he seemed — he was not speaking normally to Kenny.”

A few Jackson fans in the courtroom sniffled throughout Sankey’s testimony.

The civil suit was filed by Jackson’s family who allege that concert promoter AEG was responsible for hiring and controlling Dr. Conrad Murray, who administered the fatal dose of propofol to Jackson in 2009.

Sankey said after being copied on an email from an AEG executive about Murray that she had believed the doctor was paid by AEG.

A vintage video of Michael Jackson’s hair catching on fire during the third take of a 1983 Pepsi commercial was played for jurors Thursday as a makeup artist testified about the devastating migraine headaches the pop singer endured because of the injuries.

“I never saw anything like that in my life," Karen Faye testified. "This was someone I knew and he was on fire."

Faye, who worked with Jackson for 27 years as both a makeup and hair artist, took the stand in the second week of a wrongful death suit the singer’s mother and children filed against concert promoter AEG, which was bankrolling what was to be his comeback tour when the entertainer died in 2009 of a drug overdose.

Her testimony sometimes growing emotional, Faye recalled that when Jackson's hair caught on fire, he continued dancing down the stairs, having no idea he was burning. Finally, a friend of his ran onto the stage and wrestled him to the ground to put it out.

"All his hair was gone and there was smoke coming out of his head."

Jackson, she said, suffered intense migraines while the burns were healing, Faye said.

Instead of suing Pepsi, she said, Jackson asked Pepsi to build a burn center at Brotman Medical Center in Culver City where the singer was treated. "Everybody thought he'd sue Pepsi because it was a mistake," the makeup artist said.

Brian Panish, an attorney for Jackson's mother and three children, played a video of Jackson's hair catching on fire and another of the singer falling several stories during a concert in Munich.

In the second instance, she said, Jackson fell three or four stories when a prop he was standing on collapsed.

“When I saw what happen, I thought he could be dead,” Faye said.

But Jackson, she said, pulled himself up and continued performing. "I can't disappoint the audience," she said he later told her.

When he finished, he collapsed and security took him to the hospital, she said.

The fall, she said, left Jackson with back pain that flared when he was under physical or emotional stress.

The Jacksons are suing entertainment giant AEG, saying the firm negligently hired and supervised Dr. Conrad Murray, who gave Jackson a fatal dose of the anesthetic propofol.

AEG says Jackson hired Murray and any payments the company was supposed to give him were actually part of a multimillion-dollar advance to Jackson.

Michael Jackson’s makeup artist testified Friday that although the singer once asked her if she had painkillers, she never broached the subject of his addiction with him.

Karen Faye said that during Jackson’s 2005 molestation trial in Santa Maria she would spend a lot of time with the performer, arriving at 3 a.m. to help him get ready, and felt it was not appropriate to confront him about his misuse of prescription drugs.

“I was a place of safety for him, and peace,” Faye said. “And I didn’t want to bring up the allegations in my time with him. I wanted that to be a really safe place.”

Faye said it was her duty as Jackson’s longtime friend to keep him calm before he had to go to court.

“And no matter what he was doing, I could never blame him for that because of the pain,” Faye said, referring to the singer’s psychological pain over the charges as well as his physical pain from suffering injuries from a fire and a fall during a performance.

The makeup artist said she never saw Jackson use drugs and that there was only one instance when the singer asked her if she had painkillers.

Faye said she did request prescriptions in her name for Latisse, which is used to lengthen eyelashes, and the hair-growth drug Propecia so that she could give them to Jackson. She also inquired about Botox as a way to remedy Jackson’s onstage sweat that often caused problems with his hair extensions, but said she ultimately did not get that drug.

Since being hired to do Jackson's hair and makeup for his “Thriller” album cover, Faye said she worked with the pop star for nearly three decades, helping ready the star when he taped the 1993 statement about his decision to enter rehab following the Dangerous World Tour.

An audio recording of that announcement was played in court:

“My friends and doctors advised me to seek professional guidance immediately in order to eliminate what has become an addiction" Jackson said. "It is time for me to acknowledge my need for treatment in order to regain my health. I realize that completing the tour is no longer possible and I must cancel the remaining dates. I know I can overcome the problem and will be stronger from the experience.”

Now at the close of its second week, the civil trial pits AEG against Jackson’s mother and three children, who accuse the concert promoter of negligently hiring and controlling Conrad Murray. The doctor administered a fatal dose of propofol to Jackson in 2009 and is now serving jail time for involuntary manslaughter.

Jackson’s mother, Katherine Jackson, who has been steadily attending the trial, was absent Friday.

Faye said she sometimes spoke about Jackson’s addiction with his siblings, Rebbie, Randy and LaToya. It was her understanding, she said, that the family had attempted additional interventions with Jackson that were unsuccessful.

The makeup artist said she parted ways with Jackson during the HIStory World Tour due to problems with the tour manager as well as with Debbie Rowe, Jackson’s wife at the time.

“[Debbie] told me that she was jealous of me being there as Michael’s makeup artist,” Faye said. “She thought that Michael liked me better than her.”

After a few years, Faye said she returned to working with Jackson and that Rowe apologized.

Hired for Jackson’s comeback concert series “This Is It,” Faye said she was worried about the singer’s frail body and alerted his manager Frank DiLeo.

“[Frank] was saying pretty much, 'I got it under control, don’t worry about it,’” Faye said.

“I said, 'But he’s losing weight rapidly.' … I said, 'Why don’t you ask [costume designer] Michael Bush to verify taking in his pants and how much weight he’s actually losing?’”

A choreographer on Michael Jackson's doomed "This Is It" concert series testified Monday she was frustrated the singer was missing rehearsals but that her concerns were swept away during the last two preparation sessions for his anticipated “This Is It” comeback concerts in London.

“I finally saw what I was looking to see,” said Stacy Walker.

Walker said she was so encouraged she told her mother to buy a ticket for opening night in London. "I was very excited and relieved and hopeful,” she testified.

The testimony, coming in the third week of a wrongful-death trial in downtown Los Angeles, followed earlier reports from witnesses who described Jackson as being in such feeble health that they doubted he could pull off the 50-concert series.

One witness, Jackson’s longtime makeup and hair artist, said she warned others that she believed the pop singer was dying.

Walker had worked as a dancer on Jackson's 40-minute video "Ghost" in the mid-1990s, a job that she said was the big break of her career, and toured with him.

She was associate choreographer on "This Is It," working mainly with the dancers. Choreographer Travis Payne, she said, would often rehearse with Jackson in another room or at his rented mansion.

Walker also testified that Jackson was much skinnier than he had been when she had worked with him previously.

Walker was the first witness to testify for Anschutz Entertainment Group, the promoter of the London concerts. Jackson's mother and children are suing AEG, saying the company hired and poorly supervised Conrad Murray, the tour doctor who administered Jackson a fatal dose of the anesthetic propofol in the final days before the concerts.

AEG says that Jackson wanted Murray with him and that any payments the company was supposed to make to the doctor were advances to the singer.

Walker testified out of turn because she will be out of town and not available when AEG presents its case.

She said she wasn't "shocked" Jackson was missing rehearsals. "I was irritated he wasn’t coming.”

OK-so this choreographer "was irritated" - is that right? Who the hell do these people with this type of attitude think they are? Rather than irritated she should have been FEELING BLESSED AND FORTUNATE! She was on a HUGE project for a massive historical event! She is pretty cavalier here IMO! She has no business being irritated! MJ did what he did as the BOSS-her BOSS of the show. Screw these jerks for saying these things in court!

I'm seething. If Michael hadn't given her her "big break" in Ghosts and invited her to tour with him, she wouldn't have even been there. She should be thanking her lucky stars she had the opportunity that thousands of dancers would have given their right arm for - the chance to share the stage with the greatest entertainer of all time. Irritated?! Go take your irritation to a Kiss tryout!!

Jackson trying to get down to fighting weight witness says

The choreographer for the “This Is It” tour testified Tuesday that he had no doubts about Michael Jackson’s ability to perform in the series of comeback concerts after seeing the singer at rehearsal in the days before his death.

“I thought he was on his way to the goals he had set for himself,” Travis Payne said, adding that he and others were impressed while watching Jackson rehearse at Staples Center on June 23 and 24, 2009.

“He was not at show standards but he was rehearsing,” Payne said. “He was processing — he was having his process. I didn’t expect him to be as he would be in front of a crowd.”

Jackson died on June 25 after receiving a dose of propofol administered by Dr. Conrad Murray, who is now serving jail time for involuntary manslaughter.

The wrongful-death trial in which concert promoter AEG is accused of negligently hiring and controlling Murray is now in its third week; testimony has offered insight into Jackson’s last months of life. While the case, filed by Jackson’s mother and three children, does not seek a specific amount in damages, it could be worth millions, even billions.

Payne, who was called to the stand by AEG, said that the singer often missed rehearsals and that when he did show up, he never ran through an entire show.

“It ebbed and flowed,” Payne said of the music legend's performance. “Some days were good, some days were not as good.”

On the less than good days, the singer would appear “loopy” or groggy, the choreographer said.

“My understanding was that preparing to returning to the stage and to the public eye, Michael was undergoing sort of personal cosmetic procedures so that he could feel great and do a great job,” Payne said.

Payne said he noticed that Jackson looked thin but was satisfied with the singer’s response.

“He said, ’I’m getting down to my fighting weight,' which I took to mean that he was preparing for the performances,” Payne testified.

At one point the choreographer said he suggested Jackson get a physical therapist and that Kenny Ortega, the director of “This Is It,” arranged for one who worked with Olympians to fly in from Salt Lake City.

“At the last minute we realized that Michael was not going to go through with it,” Payne said. “He was just not comfortable with the invasion of personal space.”

When Jackson needed to be layered in blankets and required a heater to be comfortable, Payne said, he believed Jackson was merely fighting a cold.

Payne, who had worked with Jackson in the past, said he was usually hired by MJJ Productions and that the concerts represented the first time Jackson didn’t have full control.

He testified that there was a delay in his contract with AEG because the salary was not in line with his standard charges, but that things worked out after he had a conversation with Jackson. Payne also said he believed AEG was paying Murray’s salary, not Jackson.

During cross-examination, Payne was shown several photos of premieres for the documentary “This Is It.” In one, Ortega and AEG executive Randy Phillips flank Jackson’s manager, Frank DiLeo, who has a cigar hanging out of his mouth. All three are grinning.

Brian Panish, the attorney for Jackson’s family, remarked that everyone looked pretty happy.

Things became heated when Panish inquired about a text message Jackson's hair and makeup artist Karen Faye sent to Payne that accused him of lying to the media. Payne said he didn't recall such a message. He said that earlier Faye had approached him in an "aggressive" way about her concern for Jackson's health but he told her to take her concerns to Ortega.

Panish reminded Payne that he had testified in his deposition that AEG was trying to protect its “investment.”

“I don’t have a dog in this race so I’m not on either side,” an aggravated Payne countered. “I’m just saying I don’t want to be painted as somebody who’s trying to mask anything.”

Payne, who was an associate producer on the “This Is It” documentary, said the footage of Jackson had not been retouched or altered.

He also testified about Jackson’s relationship with his three children and mother, Katherine, who on Tuesday was greeted by fans outside the courtroom with calls of “God bless you” and “You look very beautiful.”

When rehearsing with Jackson at his Holmby Hills residence, Payne said the singer clearly delighted in being a father. Jackson encouraged his son Prince’s dreams of being a director, allowed son Blanket to attend his dance rehearsals, doted on his daddy’s girl, Paris, and shared meals with all three.

“I saw the beauty of their relationships,” Payne said. “I saw their loyalty to their father, I saw his loyalty to them.”

Attorney agrees to hand over emails from Jackson's manager

Emails written by Michael Jackson’s longtime manager will be turned over to the attorneys involved in an ongoing wrongful death case filed by the pop singer’s mother and his three children.

A Pennsylvania attorney for the widow of manager Frank DiLeo said Thursday that he would turn over emails that could be relevant to the case, which accuses entertainment behemoth AEG of responsibility for the pop singer’s death in 2009.

The attorney, David Regoli, who spoke via telephone in a downtown Los Angeles courtroom, said he had made a copy of DiLeo’s email inbox while he was doing work for the manager’s estate. DiLeo died in 2011.

Attorneys for Jackson’s mother and three children said they have a court order for those emails and believe they could include exchanges between DiLeo and AEG executives. Their wrongful death suit alleges that AEG hired and controlled Dr. Conrad Murray, who administered a fatal dose of the anesthetic propofol to the singer as he was preparing for a series of comeback concerts.

Regoli estimated that the digital file was about two gigabytes in size and he said he would make a log of the emails that would be pertinent to the trial. He is expected to give both the plaintiffs and the defense an update of his progress next week.

DiLeo, who died in 2011, was brought up last week in dramatic testimony given by Jackson’s hair and makeup artist.

Karen Faye said that during Jackson’s final days she tried to warn DiLeo about the singer’s health.

“Frank was saying pretty much, ‘I got it under control, don’t worry about it,’ ” Faye testified Friday.

“I said, ‘But he’s losing weight rapidly.’ … I said, ‘Why don’t you ask [costume designer] Michael Bush to verify taking in his pants and how much weight he’s actually losing?’ ”

Faye said DiLeo went to speak to Bush and she overheard the manager say, “Get him a bucket of chicken.”

“It was such a cold response,” she said. “I mean, it broke my heart.”

Jackson died soon afterward. Murray is now serving jail time for involuntary manslaughter.

I'm one that still wants to believe that Frank loved and cared about Michael and hope these e/ms prove that. There have been so many disappointments re people that used and betrayed Michael, as we saw today. I'm hoping FD was better than that.

FD cared about MJ. The whole "bucket of chicken" comment being taken SO WRONG is just typical of some MJ fans that are led around by papz and others who DO NOT keep their facts straight and and in this case they are defaming a great guy.

I always wonder what the motive is for these people doing this? What is different about bashing this deceased man using the excuse of innuendo and rumor? I see why we protect MJ against it, so why not a good friend of his? He can't defend himself any longer either. I really wish people would simmer down. It is really difficult enough without more drama that is foundless!

Admin: Totally agree with you. I saw your posts on another site re this chicken comment. I couldn't believe how askew it was all getting. First of all the only source for the comment was K. Faye who clearly did not like FD per her testimony last week. There is no other corroboration. Second, IF Frank said it, he could have said it in the context of (as another poster put it), "Get the kid some chicken and maybe we can get him to eat." No one knows because no one was there and Karen is the only source. Pointless. Too many agendas at cross purposes.
I know FD supported Michael thru that hideous trial when few others did. I also read that after Frank died, his wife said he was "devastated" by Michael's death. The 2008 Allgood contract controversy is just that - controversial. I spent time researching that a while ago and it's not clear exactly what happened there and who did what under whose authority.
I hope these e/ms prove that Frank cared about and supported Michael so we can put at least one issue to rest!

I have no desire at all to engage with people who go off half cocked about people who were in Michael's life. I am so sick of these people and their know it all "analysis" as if they actually know anything more than anyone else.

To me it is this way, if you actually KNEW Michael, then you know what's what in some of these circumstances. If you did not know Michael at all in any way then don't act like you know him, what was ever actually in his mind, or his motives in serious matters. It really is not anyone's business when it came to his actual personal life.

All we as fans ought to want to know is that he was happy, and was healthy and had the emotional and spiritual support we would all need if ever having to go through a life like MJ had.

I believe in MJ's decisions and his choice of most of his friends. Who of us hasn't had different calibres of friends so to speak. Some come and go. Like we know-we can count our 'real' friends on one hand. We all have the fence rider types. When all is good they are there. When crap falls apart-where'd they go? Same with Michael it seems. No different in that way as the rest of us. We all have trusted people and have gotten burned. But I believe too that from what I know about Dileo, and read through the years, I trust that he was MJ's friend.

A professional concert tour director testified Friday in the Michael Jackson wrongful death trial that a doctor's demand for $5 million to serve as the singer's tour physician "raised a red flag."

Marty Hom, who has spent 25 to 30 years as a tour director and tour manager, said that Dr. Conrad Murray's original demand was "outrageous." Murray, a cardiologist who closed his practice to serve Jackson, eventually agreed to work for $150,000 a month.

Hom, who testified as an expert witness, also said he would never tell a director he had checked out a doctor if he hadn’t, a reference to claims by the Jackson family about an AEG executive.

A portion of Hom's March 25 video deposition was played to the jury in the lawsuit brought by Jackson's mother and three children. They contend that entertainment giant AEG negligently hired and supervised Murray, who administered a fatal dose of the anesthetic propofol to the singer to combat his insomnia. AEG says that Jackson hired Murray and that any payments the company was supposed to make to the doctor were advances to the singer.

Anschutz Entertainment Group had deposed Hom as an expert witness, paying him $500 a hour. In an unusual move, the Jacksons' attorneys played about 45 minutes of the deposition, taken under oath. Brian Panish, one of the family's lawyers, said he played the testimony to ensure the jury heard it, even if AEG did not call Hom during the trial.

Hom also testified he had never been on a tour where the artist brought a doctor along, although he later said doctors toured with the Rolling Stones and Blink 182, but Hom did not work with them.

Much of Hom's testimony centered on the relationship between a tour manager, performer and doctor. A key question in the lawsuit is whether Murray, who was in desperate financial straits, was more concerned with Jackson's interests or AEG's.

Hom said it was not appropriate for the tour manager or promoter to inject themselves into the doctor-patient relationship.

Asked if it would be OK for someone to speak to the performer's doctor without the artist present, he answered, "I thought it was the doctor's responsibility to say no."

He said he knew of no instance where a promoter or producer had a private conversation with the artist's doctor.

He testified that when performers were ill, "my natural instinct is to go to that doctor and ask him, 'Is that dancer going or musician going to be able to make that show in a week?”

Hom also testified that he knew of no instance where a promoter or tour manager paid the performer's manager.

Panish said outside court that he will later introduce evidence that AEG was paying Jackson's managers, which could be a conflict of interest.

The promoter and producer putting on Michael Jackson's ill-fated "This Is It" concert series was paying his manager $100,000 a month, the only time entertainment giant AEG made such an agreement, a company lawyer testified Monday.

Shawn Trell, senior vice president and general counsel for Anschutz Entertainment Group, testified in the Jackson family's wrongful-death lawsuit that the money was paid to Thome Thome.

The payments appear to be a potential conflict of interest, since a personal manager is supposed to represent the performer's interests.

In addition, Trell was shown a report AEG sent Jackson's estate that included a request it be repaid $300,000 it had given Conrad Murray, the doctor who administered the fatal dose of the anesthetic propofol to Jackson.

"To me, it's a mistake," Trell said.

Previous testimony showed AEG never paid Murray.

Brian Panish, an attorney for Jackson's mother and children, who filed the lawsuit against AEG, said in court that the company had been seeking $30 million in advances from Jackson's estate.

Earlier in the day, an AEG executive testified that Murray's salary was never listed on a budget as an artist advance.

The Jacksons say in their suit that AEG negligently hired and supervised Murray, while the company says that Jackson wanted him hired and that any salary it was supposed to pay him were advances to the singer.

Julie Hollander, AEG's vice president and controller also testified that she didn't know of any other instance in which the firm had hired a doctor to go on a concert tour.

“I know in my experience it is not typical for the promoter and tour producer to hire a doctor,” she said.

She also testified that when Jackson died in June 2009, shortly before his 50 concerts were set to begin in London, the production was about $2.5 million over budget.

Michael Jackson's family offered to settle lawsuit lawyer says

A lawyer for Michael Jackson’s family said they offered to settle their wrongful-death suit against concert promoter Anschutz Entertainment Group, but that they never got an answer.

Kevin Boyle, an attorney for Jackson’s mother and three children, said the family made the offers in January and March.

Boyle would not provide details but said AEG’s insurance would have paid, “which means they could have settled the case without them paying a dime of their money.”

He said AEG has never offered to settle “and they haven’t apologized.”

Marvin Putnam, an attorney for AEG, said it was inappropriate to discuss settlement discussions.

“We don’t settle matters that are utterly baseless,” he said. “We believe that is the case in this matter. I can’t see why we would consider a settlement as anything other than a shakedown.”

AEG was the promoter and producer of Jackson's comeback concert series in London. The singer died June 25, 2009, at the end of rehearsals, of an overdose of the anesthetic propofol administered by Dr. Conrad Murray.

The Jacksons say in their lawsuit that AEG negligently hired and supervised Murray. AEG says Jackson hired Murray and that any money the firm was supposed to pay him would have been loans to the singer.

The trial, in its fourth week, is expected to take as long as three more months.

Director feared Michael Jackson 'could have hurt himself'

Michael Jackson tour director Kenny Ortega wrote in an email to the president and chief executive of AEG Live that the singer "could have hurt himself," according to court testimony.

The email, in which Ortega said the singer was in frail mental health, was shown to the jury Monday. It was sent to Randy Phillips, head of the company promoting Jackson's London concerts, five days before Jackson died in 2009.

Ortega wrote "trouble at the front" in the email's subject line.

"There are strong signs of paranoia, anxiety and obsessive-like behavior," Ortega wrote. "I think the very best thing we can do is get a top psychiatrist in to evaluate him ASAP. I honestly felt if I had encouraged or allowed him on stage last night he could have hurt himself. I believe we need professional guidance in this matter."

Testimony Monday in the wrongful-death lawsuit Jackson's mother and three children have filed against Anschutz Entertainment Group also revealed Ortega didn't have a contract, just a series of emails.

It was revealed earlier that Dr. Conrad Murray, who administered the fatal dose of the anesthetic propofol to Jackson, did not have a signed contract with the promoter of the London concerts by the singer, who died two weeks before they were scheduled to begin.

As Murray, who worked with the singer for two months to prepare him for the concerts, signed his contract the night before Jackson died, but neither the singer nor a company executive signed.

Asked if AEG paid Ortega based on the emails, Shawn Trell, AEG's general counsel answered, "In Kenny's case, that's true."
"And Dr. Murray had an agreement with AEG based on a series of emails?" Panish asked.

"No. I don't believe so," Trell replied.

Asked why Ortega didn't need a contract, Trell said, "Kenny Ortega is different."

Panish showed the jury a series of emails between Murray and AEG executives, including one dated May 8, 2009, in which AEG's Paul Gongaware agreed to pay the doctor $150,000 a month. Jackson died June 25, 2009.

In another email, tour accountant Timm Woolley went over details of employment with Murray, including a provision that if he didn't travel on Jackson's chartered plane, he would fly first class.

In a May 22, 2009, email, Murray wrote to Woolley that he was faxing over a voided check so that money could be wired directly to his account.

When Panish insisted that Murray was working for AEG in May 2009, Trell replied: "No. I totally disagree with that statement."

The Jacksons' lawsuit contends that AEG "hired and controlled" Murray, while the entertainment giant argues that any money it was supposed to pay Murray was an advance to Jackson, who hired the doctor.

Previous testimony has shown that Murray was never paid. On Monday, Trell was shown a report that AEG sent to Michael Jackson's estate that included a request that it be repaid $300,000 it had given Murray.

"To me, it's a mistake," Trell said.

Witness: Michael Jackson passed medical examination with flying colors

A few months before Michael Jackson’s death, AEG executives were told that the performer had passed a medical exam “with flying colors,” an in-house attorney for the company testified Wednesday.

Shawn Trell, senior vice president and general counsel for AEG, said he contacted a London insurance broker in November 2008 to inquire about cancellation insurance for “This Is It,” a series of planned concerts touted as Jackson’s comeback tour.

Cancellation insurance, Trell said, is a typical way to recoup advances made to an artist when an event falls through. According to its contract with Jackson, AEG had advanced the singer close to $30 million, an amount that included a $15-million line of credit and $7.5 million to cover production costs to mount the shows.

Insurance carriers, however, were “skittish” due to tabloid reports about Jackson’s health, Trell said. The London broker, Bob Taylor, suggested that Jackson have a medical exam by Dr. David Slavit of New York, who was trusted by the carriers.

Trell said the exam took place in February 2009, and that although he wasn’t privy to Jackson’s medical records, he was satisfied.

“Mr. Taylor’s exact words to me were, ‘Other than a slight case of hay fever, he passed with flying colors,’” Trell testified in the trial of the wrongful-death lawsuit brought by Jackson’s mother and three children against AEG.

AEG ended up securing a $17.5-million insurance policy that listed among its exclusions “the illegal possession or illicit taking of drugs and their effects.”

Trell said he continued to check in with Taylor to see if the marketplace had changed and the coverage could be increased because it was unusual for the insurance not to cover the entire advance made. “We were just trying to bridge the gap between cost and expense,” he testified.

A second insurance physical was scheduled for July 6, 2009. “We had no reason to believe that he wouldn’t pass,” Trell said.

On June 25, 2009, at 5:54 a.m., London time, Taylor sent an email to Dr. Conrad Murray, who had been brought onto the tour to tend to Jackson. The email, introduced as evidence in the case, read:

“The insurers have specifically requested information on the following:

Press reports on the artist at various times using a wheelchair, and whether any of these occasions were as a result of a medical issue.

Press reports that the artist had, or has, suffered a back injury.

Press reports that the artist is suffering, or has previously suffered from lupus.

Press reports that the artist is suffering, or has previously suffered from cancer.

Press reports that the artist was hospitalized in 2005.

Dates and brief details of any cosmetic procedures, and specific details of any complications.

Press reports that the artist has suffered from lung infection/emphysema and chronic gastrointestinal bleeding.

Press reports that the artist has minimal diet (is possibly anorexic).”

Jackson died hours later from a fatal dose of the anesthetic propofol administered by Murray.
