Michael Jackson Wrongful Death Trial
Panish Shea & Boyle LLP represents the mother and children of Michael Jackson in the family's wrongful death lawsuit against AEG Live, LLC, AEG Live Productions, LLC, Brandon Phillips and Paul Gongaware.

At trial, the jury will be asked to decide whether the defendants negligently hired, retained or supervised Conrad Murray, the doctor who administered a fatal dose of the anesthetic drug propofol to Michael Jackson on June 25, 2009. Dr. Murray was later convicted of involuntary manslaughter in connection with Michael Jackson's death. The trial began on April 29, 2013 and is expected to last for several months.

The Panish Shea & Boyle LLP attorneys representing the Jackson family at trial are Brian Panish and Kevin Boyle.

LAPD Detective Testifies in Michael Jackson Case

Plaintiffs completed the direct examination of LAPD Detective Martinez on Thursday morning. The defense cross-examined him for approximately two hours.

On redirect by plaintiffs’ counsel in the afternoon, Detective Martinez stated that after all of the questioning by the defense, he had not changed his opinions that Dr. Conrad Murray was in “dire financial straights” as of May and June 2009 and had a financial motive for violating the Hippocratic Oath. Detective Martinez also confirmed his opinion that the AEG Live CEO’s business card and the written agreement between AEG Live and Dr. Murray, both of which were found in Dr. Murray’s car were further evidence of d. Murray’s financial motive for bending the rules.

There is no trial on Friday, May 3, 2013, because Judge Palazuelos is attending a judicial conference. Trial will resume on Monday, May 6, 2013. The plaintiffs will call as witnesses the LA Coroner Medical Examiner and the LA Coroner Toxicologist.

The Los Angeles Coroner Medical Examiner testified that Michael Jackson’s organs were completely healthy at the time of his death, and that there was no evidence that he would not have lived a full life-span were he not killed by the overdose of propofol. He also testified that there was no evidence that Michael Jackson self-administered the propofol

Dr. Daniel Wohlgelerntner, a highly credentialed cardiologist, testified that Dr. Conrad Murray was unfit and incompetent to perform the task of being Michael Jackson’s personal physician as he had no training in sleep medicine, addiction medicine, or anesthesia. He testified that AEG ignored numerous red flags in hiring Dr. Murray that should have led them to make further inquiry before they hired him. Dr. Wohlgelerntner testified that the contract between AEG and Dr. Murray called for Dr. Murray to act at the direction of AEG, and not of Michael Jackson

Alif Sankey, associate producer of the This Is It Tour, testified the entire day. Ms. Sankey testified that based on her observations, she was concerned that Mr. Jackson was going to die, and that she reported her concern in writing to the show Director, Kenny Ortega. On cross-examination, Ms. Sankey testified that everyone who worked on the This Is It Tour was hired and paid by AEG. Ms. Sankey read the email to the jury in which Paul Gongaware of AEG stated that it was AEG, and not Michael Jackson, that was paying Dr. Murray. Thursday, Karen Faye, Michael Jackson’s long-time make-up artist, will testify.
