LOS ANGELES — Gov. Gray Davis appointed two local veteran prosecutors Friday to six-year terms as judges on the Los Angeles County Superior Court, his office reported.

Richard Stone, a deputy district attorney since 1986, and Yvette Palazuelos, an assistant attorney in the U.S. attorney's office since 1990, will assume the posts, said Hilary McLean, a spokeswoman for Davis.

For the last two years, Stone, 43, has prosecuted gang-related crimes as a member of the district attorney's Hardcore Gang Unit. The 1998 Santa Monica Police Association's "prosecutor of the year," Stone was elected to the judicial post during the March primary election and was to take office in January. The appointment allows him to immediately become a judge, McLean said.

Palazuelos, 37, specializes in prosecuting large-scale narcotics traffickers and money launderers. She has won five special achievement awards from the U.S. Department of Justice and two certificates of appreciation from the Drug Enforcement Administration.

Los Angeles Superior Court Judge Yvette M. Palazuelos ruled that there were not enough details currently in Oksana Grigorieva's complaint against Sammy Oriti to support her claims that he converted the photos to his own use without permission and invaded her privacy.

Palazuelos did rule that other portions of the lawsuit were adequate, including breach of contract and misappropriation of the right of publicity allegations.

She gave Grigorieva's lawyer, Todd S. Eagan, the chance to file an amended complaint.

Grigorieva's lawsuit was filed last August. According to her court papers, the Russian beauty met Oriti in 2004, when he offered to be her talent manager and said he could get her a deal modeling lingerie.

The photo session took place the same year at Grigorieva's home, and she paid for all costs associated with it, according to the suit.

She says Oriti promised her that the photos would only be used in ads promoting the lingerie company's business. Grigorieva says she did not find out until last April that Oriti still had the photos and disseminated them to media outlets without her permission.

In his argument that his client's privacy was invaded, Eagan said the photos were only intended to be seen by one company, not the entire world via the Internet. He also maintained the release of the photos would be considered offensive and objectionable to a reasonable person in the same situation.

However, Palazuelos questioned whether the photos were offensive and said she agreed with defense attorney Ronald M. Lebow, who wrote in his court papers that stolen photos of Pamela Anderson and Tommy Lee published in Penthouse many years ago were far more explicit, yet found to be constitutionally protected.

Gibson is the father of the 39-year-old Grigorieva's infant daughter, who was born in October. She also has a 12-year-old son, Alexander, from a previous relationship with British actor Timothy Dalton.

A big, fat 'Greek' lawsuit


A lawsuit brought by Nia Vardalos regarding profits for the movie she wrote and starred in, "My Big Fat Greek Wedding," was referred Monday to mediation.

Vardalos and her co-producers, Tom Hanks and his wife, Rita Wilson, maintain that Gold Circle Films, co-financier of the hit 2002 film, owes them a share of profits that they claim have gone unpaid. If they can prove fraud, they also are entitled to seek punitive damages.

Los Angeles County Superior Court Judge Yvette M. Palazuelos told them to try mediation but set a trail date of Jan. 20 in case that fails.

In addition to Gold Circle, which is backed by billionaire Norm Waitt Jr., co-founder of Gateway Inc., the suit names Big Wedding Productions and Vortex Pictures as defendants.

Judge Sides With Rihanna in Home Lawsuit

Singer Rihanna, a Pacific Palisades resident, progressed in her $6.9 million lawsuit involving a Beverly Hills house and construction defects.

Rihanna won a round in court Thursday when a judge set in motion a possible default judgment against a former co-owner of a Beverly Hills house the entertainer bought for $6.9 million in 2009 and was found to have construction defects.

Los Angeles Superior Court Judge Yvette Palazuelos took the action after Heather Rudomin failed to appear in court as ordered for a hearing in the "Only Girl" singer's lawsuit for the third straight time. The judge said she would not enter a final judgment against the woman until after the trial, which is scheduled for Feb. 24, 2014.

The lawsuit was filed in August 2011 against Prudential California Realty and several other defendants, including Rudomin and her husband, Adrian, subcontractor Richard Williams and the company that helped the Rudomins renovate the home in 2007 08, Landmark Design Group LLC.

The 25-year-old singer, whose full name is Robyn Rihanna Fenty, says the home had water leaks and was flooded in a January 2010 storm.

Palazuelos dismissed a previous order in which she tentatively issued $500 in sanctions against the Rudomins for failing to appear for previous hearings. In addition to today, Adrian Rudomin showed up in court as ordered March 12, but his wife did not.

Adrian Rudomin told Palazuelos that his spouse was ill and could not appear today. But Rihanna's attorney, Miles Cooley, was skeptical and said the couple has frustrated attempts to get the case moving.

"The Rudomins are not responding to discovery and at a certain point the excuses need to stop,'' Cooley said.

Cooley said he will be serving a notice on Adrian Rudomin to appear for a deposition and then try and persuade the couple to participate in mediation.

In taking the action against Heather Rudomin that could lead to a default judgment, Palazuelos said she has not seen any proof of the woman's illness other than what her husband says. The judge said she would at the very least need a sworn declaration from Heather Rudomin or her doctor.

Palazuelos gave the two sides time to try to resolve the case with the help of a mediator, setting a deadline for completion of July 10.

Cooley says that Rihanna relied on the Rudomins' representations concerning the home throughout the transaction. The singer has since moved. She owns a home off Sunset Boulevard in Pacific Palisades that was recently "swatted," or swarmed by a police SWAT team based on a false report of a crime there.

Adrian Rudomin said before Thursday's hearing that he was not aware when he and his wife sold the home that Rihanna was the buyer.

Personal note: Court should have been recessed for the rest of this week IMO yesterday AM when the news of Paris was first announced. This is the epitome of judicial ineptitude when she cancels entire days of court sessions for attorneys to attend graduations and she personally can't even schedule a damn dental appt. in the evening or on a weekend wasting an entire half day of court time when her *** should have been on that bench! Palazuelos is crass and biased and I for one am really pissed off that she didn't have the sense or the respect for Katherine Jackson and her family at this time to allow them to attend to and better manage a family crisis especially when that POS Randy Phillips is flapping his liarmouth this week!!!! This is KJ's lawsuit and I think a motion should have been filed to stop the proceedings until KJ can come back! WTH!
